BARIACCESS® – Notice of Privacy Practices (NPP)

This Notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully

Who we are

BARIACCESS® is a digital health program operated by V.E. Andrei MD–Bariatric Associates, P.A. (“we,” “us,” or “the Practice”). We may support your care by helping you collect and view health metrics (including device and app data) and share them with your care team when appropriate.


Our obligations

  • We are required by law to maintain the privacy and security of your protected health information (PHI).

  • We must provide you with this Notice describing our legal duties and privacy practices.

  • We will follow the terms of this Notice currently in effect.

  • We will let you know promptly if a breach occurs that may have compromised the privacy or

  • security of your information.

How we may use and disclose your information (without additional authorization)

  • Treatment: to support your care, coordinate with providers, and manage treatment plans.

  • Payment: to bill and collect payment for services and confirm coverage when applicable.

  • Health care operations: quality improvement, auditing, staff training, and business management.

  • As required by law: public health and safety, law enforcement requests, and other legal obligations.

  • To avert a serious threat to health or safety, consistent with applicable law.

How we may use and disclose your information (authorization required)

We will ask for your written/electronic authorization before we:

  • Share PHI with third-party apps or services that are not acting on our behalf as Business Associates (when required).

  • Use or disclose PHI for marketing purposes (with limited exceptions).

  • Sell your PHI.

Business Associates and integrated services

We may use vendors (“Business Associates”) to help us operate BARIACCESS® (for example: hosting, analytics, secure messaging, and device integrations). Business Associates are required by contract to safeguard PHI and use it only as permitted by law and by our agreement.


Your rights

  • Get an electronic or paper copy of your medical record.

  • Ask us to correct your medical record.

  • Request confidential communications.

  • Ask us to limit what we use or share (we may not be able to agree to all requests).

  • Get a list of disclosures (accounting of disclosures) in certain cases.

  • Get a copy of this Notice at any time.

  • Choose someone to act for you (healthcare proxy, legal guardian).

  • File a complaint if you feel your rights are violated.

Access, downloads, and device data

BARIACCESS® may allow you to connect devices or apps (e.g., glucose monitoring or activity tracking). When you connect a device/app, we may receive metrics and display them in your profile to support care coordination and coaching. You can disconnect integrations and manage consents in-app.


Changes to this Notice

We may change the terms of this Notice, and the changes will apply to all information we have about you. The updated Notice will be available in the BARIACCESS® app/web app and upon request.

Complaints

You may complain to us or to the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.
