Licensing Terms & Conditions

Relationship Between Bariatric Associates and BARIACCESS®

BARIACCESS® is a standalone program and platform developed and owned by BARIACCESS®. Bariatric Associates licenses the BARIACCESS® program for use within its own clinical and wellness services.

This licensing arrangement allows Bariatric Associates to integrate BARIACCESS® into its patient experience while maintaining Bariatric Associates as the primary provider of care.

​

License Grant

BARIACCESS® grants Bariatric Associates a non-exclusive, revocable license to use the BARIACCESS® program, including its software, tools, workflows, and supporting materials, as part of Bariatric Associates’ services.

​

This license permits Bariatric Associates to:

​

  • Integrate the program into its clinical and wellness offerings

  • Customize workflows, content, and patient experience

  • Apply its own branding and presentation

All use must continue to reference BARIACCESS® as the underlying program and platform.

​

Ownership & Intellectual Property

BARIACCESS® retains all ownership rights, intellectual property, trademarks, software, methodologies, and program design associated with the BARIACCESS® platform.

Nothing in this agreement transfers ownership of any part of the BARIACCESS® program to Bariatric Associates or any third party.

​

Branding & Attribution

Bariatric Associates may brand the program as part of its services, provided that:

​

  • BARIACCESS® is clearly identified as the underlying program or platform

  • No representation is made that Bariatric Associates owns or developed BARIACCESS®

​

The BARIACCESS® name, trademarks, and program references must be used in accordance with brand and attribution guidelines.

​

Patient Relationship & Responsibility

Patients who participate in programs offered by Bariatric Associates are patients of Bariatric Associates, not customers of BARIACCESS®.

​

Bariatric Associates is solely responsible for:

​

  • Clinical care and medical decision-making

  • Patient communications and treatment plans

  • Compliance with applicable healthcare laws and regulations

​

BARIACCESS® does not provide medical advice, diagnosis, or treatment.

​

Data & Program Use

BARIACCESS® provides tools to support behavioral awareness, continuity, and engagement. How those tools are applied within patient care is determined by Bariatric Associates.

​

Patient data usage, privacy practices, and care delivery are governed by Bariatric Associates’ policies and applicable regulations.

​

Liability Disclaimer

BARIACCESS® provides the program “as is” as a licensed platform and does not assume responsibility for:

​

  • Clinical outcomes

  • Medical decisions

  • Patient treatment plans

  • Care delivery or patient management

​

All clinical responsibility remains with Bariatric Associates.

​

Independent Entities

BARIACCESS® and Bariatric Associates are independent entities. Nothing in this licensing arrangement creates a partnership, joint venture, or agency relationship beyond the limited license described here.

​

Modifications & Termination

Licensing terms, program features, and integration details may be updated from time to time. Continued use of the BARIACCESS® program by Bariatric Associates constitutes acceptance of any updated terms.
